Mr. Hartinger and Mr. Hutching’s presentation, “Independent Contractors and CalPERS: How to Prepare, What to Avoid,” will explore the regulations and intricacies surrounding the California Public Employees’ Retirement System (CalPERS) classification of independent contractors as common-law employees in the wake of AB 5, which leaves employers liable for their retirement benefits. Bringing their experience litigating this issue before CalPERS, the pair will share their understanding of applicable policy and legislative trends as well as how to flag independent contractors that are at risk of being classified as an employee. They will present from 9:00-10:15 a.m. on Thursday, February 6.

“In the wake of AB 5, it’s essential for city managers to have a strong understanding of potential pension obligations to reclassified independent contractors,” said Mr. Hartinger. “Dane and I are looking forward to sharing our insights and connecting with city managers from across the state up in Napa.”

RPLG, a Silver-Level Partner of the League of California Cities, will have a number of attorneys in Napa during the conference.
